The basics: what Buy America actually requires

When a project receives federal funding — through the Infrastructure Investment and Jobs Act (IIJA), the American Rescue Plan, FEMA grants, HUD programs, or dozens of other sources — the Buy America provisions in the underlying legislation typically apply.

At its core, Buy America requires that iron, steel, manufactured products, and construction materials used in the project be produced in the United States. The specific threshold, the definition of "produced in the United States," and the scope of covered items depends on which law applies and which federal agency is overseeing the grant.

The most common standard you'll encounter:

Under the Build America, Buy America Act (BABA), covered manufactured products must have all manufacturing processes occur in the United States. For iron and steel, all manufacturing steps must also be domestic. The threshold: if the total cost of manufactured products in the project exceeds the de minimis amount, BABA applies.

What a compliant submittal actually needs

When a contractor submits a product for approval, the specifier, owner, or federal agency reviewer needs to see documentation that the product meets the Buy America standard. What counts as sufficient documentation varies — but in practice, you typically need:

  • Manufacturer letter of compliance — A signed letter from the manufacturer stating the product is domestically manufactured and meets the applicable Buy America provisions. Sometimes called a "BABA support letter" or "Buy America certification letter."
  • Country of origin statement — Documentation indicating where the product was manufactured, often including the specific facility location.
  • Product spec sheet — Technical specifications confirming the product meets the project specification requirements.
  • Supporting manufacturer data — In some cases, reviewers ask for evidence of domestic steel sourcing, assembly location, or supply chain documentation.

The PE of record and the owner's representative ultimately decide whether documentation is sufficient. Buy BABA provides everything we have on file — but we always recommend contractors confirm documentation meets their specific project and agency requirements before submitting.

Manufacturer-supplied origin information available. Additional documentation may be needed depending on your project's requirements.

What Buy BABA is — and isn't

The catalog price is appropriate for smaller purchases — replacement fixtures, minor repairs, small quantities. For project work — anything going into a submittal package, anything federally funded — we recommend requesting a quote. Why?
