Buy America–Compliant Products for Federally Funded Projects | BABA Documentation Included | B2B Sourcing Platform

About Buy America compliance

What is Buy America / Build America Buy America (BABA)?

Buy America is a set of domestic preference requirements that apply to federally funded infrastructure projects. The Build America, Buy America Act (BABA), enacted in 2021, significantly expanded these requirements to cover all federal financial assistance for infrastructure — not just traditional categories like highways and transit.

Under BABA, iron, steel, manufactured products, and construction materials used on covered projects must be produced in the United States. The specific standard depends on the product category: for manufactured products, all manufacturing processes must occur domestically.

Does Buy America apply to my project?

If your project receives federal financial assistance — grants, loans, or other funding from a federal agency — Buy America provisions likely apply. This includes funding from IIJA/BIL, American Rescue Plan, FEMA, HUD, FAA, and many other programs.

The specific requirements depend on the funding source and the implementing agency. We recommend consulting with your project owner, legal counsel, or compliance specialist to confirm applicability for your specific project.

What documentation does a federal reviewer typically require?

Reviewers typically want to see: a manufacturer compliance letter certifying domestic production, a country of origin statement, and the product spec sheet. Some agencies or owners may require additional documentation such as supply chain affidavits or facility information.

The standard varies — always confirm with your PE of record and the project owner what documentation they require before submitting.

What's the difference between Buy America, Buy American, and BABA?

Buy American Act (1933) — applies to federal procurement (what the government buys for itself). Different law from Buy America.

Buy America — a set of requirements in various federal statutes (Surface Transportation, Water Infrastructure, etc.) requiring domestic products on federally assisted projects.

Build America Buy America Act (BABA, 2021) — the broadest expansion of domestic preference requirements, applying to all federal financial assistance for infrastructure.

When people say "Buy America compliant" in the construction context, they're usually referring to BABA or the pre-existing Buy America provisions in their specific program's authorizing legislation.

About Buy BABA

What is Buy BABA and how does it work?

Buy BABA is a sourcing platform for contractors on federally funded projects. We curate a catalog of domestically manufactured construction products — primarily Division 10 specialties and Division 22 plumbing fixtures — and maintain the compliance documentation manufacturers provide to us.

When you find a product in our catalog, you can download available documentation directly, request a project quote, or order from the catalog. Our goal is to eliminate the hours contractors spend chasing compliance paperwork.

Is Buy BABA affiliated with the government?

No. Buy BABA LLC is a private company. We are not affiliated with any federal agency, and we do not certify compliance. We are a sourcing platform that organizes manufacturer-supplied compliance documentation.

What does the compliance level rating mean?

We rate each product from Level 1 to 5 based on what documentation we have on file:

  • Level 5: Full submittal package — BABA letter, origin statement, spec sheet, and manufacturer data
  • Level 4: BABA support package — BABA letter and key documentation
  • Level 3: Domestic manufacturing verified — origin confirmed, BABA letter available on request
  • Level 2: Origin data available — manufacturer-supplied origin information
  • Level 1: Spec sheet only — compliance documentation not yet verified

These ratings reflect what we have on file — they are not a determination that a product will be accepted on any specific project.

Can I use Buy BABA documentation in my project submittal?

Yes — that's exactly what it's for. The documentation we provide comes from manufacturers and is intended to support project submittals. However, you are responsible for confirming that the documentation meets your specific project's requirements and that it remains current at time of submittal.

We provide documentation on an "as-is" basis. Read our full compliance disclaimer.

Ordering & quotes

When should I request a quote vs. order from the catalog?

Order from the catalog for small purchases — replacement fixtures, minor repairs, items where catalog pricing works for you.

Request a quote for project work — anything going into a submittal, project quantities, or when you want us to confirm documentation is current and project-specific at time of purchase. Project quantities typically qualify for better pricing, and we can coordinate with the manufacturer to ensure documentation is fresh.

How long does it take to get a quote?

We typically respond to quote requests within 1 business day. For complex projects or products that require coordination with manufacturers, it may take 2–3 days.

Can you source a product I don't see in the catalog?

Yes. Submit a spec section or describe what you need in a quote request, and we'll source it. We have relationships with manufacturers beyond what's currently listed in the catalog, and we'll tell you honestly if we can't source something compliantly.
